Arthur Ma

Biography

Arthur is a Partner in DaHui Lawyers’ litigation and arbitration team. Over the years, by focusing on complex commercial disputes resolution, Arthur has accumulated extensive experience in commercial arbitration and litigation involving foreign interests and is especially adept at cross-border disputes and enforcement of foreign arbitration awards. He also honed his expertise in international arbitration. Prior to joining DaHui, Arthur worked with major international and PRC law firms in their Shanghai, London, Washington DC, Hong Kong and Beijing offices for more than 12 years. During this period, he represented clients in both domestic and foreign litigation and arbitration proceedings under different jurisdictions and different laws and rules, including disputes arising out of large-scale engineering and construction, joint ventures, equity transfers, private equity investments, international sales of goods, etc. He has attended nearly twenty international arbitration hearings in different cities of the world and obtained rich experience in hearing advocacy. He also has experience in compliance and FCPA investigations. Arthur is a native Mandarin speaker and is fluent in English.

Offshore Arbitration and Litigation

Represented a major State-owned project contractor in an UNCITRAL arbitration against its Singapore subcontractor in a dispute arising out of an EPC contract related to a water plant project in the Middle East
Represented a private Chinese contractor in an UNCITRAL arbitration against the Indonesian project owner in a dispute arising out of an EPC contract related to a power plant project in Indonesia
Represented a leading multinational exhibition company in an HKIAC arbitration against a Chinese individual in a dispute arising out of a non-compete agreement
Defended a major Chinese state-owned energy company and its Hong Kong affiliate in the High Court in London regarding a tortious interference dispute which arose from a chartering agreement, subject to the laws of New Jersey, USA
Defended a major Chinese state-owned energy company in an LCIA arbitration with a value in excess of one billion US dollars regarding a dispute on the performance and termination of a large-scale offshore equity transfer
Represented a major Chinese state-owned overseas project contractor in its cost claim and preparation for an ICC arbitration against its general contractor in Taiwan with respect to an expansion and reconstruction project in Saudi Arabia
Represented a major Chinese state-owned mechanical & electrical equipment manufacturing company in its cost claim and preparation for an ICC arbitration against its Malaysian general contractor regarding a thermal power plant project in Indonesia, and successfully helped the client achieve settlement
Defended twenty one respondents including overseas and domestic companies and individuals in a HKIAC arbitration with respect to a claim of fraud and misrepresentation filed by a foreign PE fund
Represented a major Chinese airline company in an ICC arbitration against two Canadian companies with respect to a breach of a training contract
Represented a Spanish machine company in an ICC arbitration against its Chinese joint venture partner regarding a dispute on their joint venture agreement
Defended the aforesaid Spanish Company in an UNCITRAL arbitration seated in Hong Kong against the above mentioned Chinese party in a dispute arising out of a loan agreement
Advised a major US energy investment fund and several individual shareholders on PRC law issues in an UNCITRAL arbitration seated in London brought by a Thai company regarding an equity transfer agreement
